blue squareCOURSE TERMS AND CONDITIONS

  • unless otherwise requested all courses are usually conducted at client premises and are of two day's duration, commencing at 9.15 am sharp and finishing by 5 pm. Attendees to arrive at 9.00 am. There will be two 15 minute tea/coffee/comfort breaks and 45 minutes for lunch.
  • the Course Leader will be Trevor Gilbert in all instances unless unavailable due to pre-booked trial/tribunal commitments or an unavoidable reason, in which case one of his senior expert witness associates, an approved trainer, will lead the course.
  • all courses will be delivered in partnership with a practising and experienced barrister.
  • all training and materials are delivered in plain English.
  • dress code; business or casual clothing on first day. Business clothing only on second day.
  • accommodation requirements: Private room of sufficient size to seat 11. Seating/table arrangement will be in a U with one separate desk, or a square. Meals and refreshments to be arranged by client at its expense.
  • learning/media equipment: Any aids including a projector, OHP, TV, DVD, laptop and playback facilities will be organised by the client at its own expense. This will also include notepads, pencils and flipcharts.
  • travelling expenses and subsistence; for locations necessitating overnight accommodation and subsistence for the course leader, costs will be reimbursed by the client to include a minimum 4-star hotel accommodation and first class train fares.
  • the Art of Giving Evidence training course complies with Bar Council guidelines, in particular that none of those involved should have any personal knowledge of the matters in issue in a trial or hearing in question, specifically relating to the delegate or the delegate's employer, vis-à-vis that its purpose is simply to give a witness greater familiarity with and confidence in the process of giving oral evidence and that none of the material used should bear any similarity whatever to the issues in the current or forthcoming proceedings in which the participants are or are likely to be witnesses.
  • barristers taking part in mock examinations will not rehearse, practice or coach a witness in relation to his/her evidence on an exercise which is the same as or similar to those of any current or impending trial, hearing or proceedings at which a participant is or is likely to be a witness.

Course Fees:


  • Two-day comprehensive course: £4,000.
  • One-day intensive course: £3,000
  • One-day programme regarding Employment Tribunals: £3,000
  • Half-day mock trial/cross examination: £1,500

Fees include:

  • Course workbook for each delegate.
  • Tuition and participant certificate for each delegate.
  • Where meeting rooms are unavailable we are happy to arrange and will charge at cost.

All invoices will attract VAT at the prevailing rate.

Payment:


  • Payment is deemed an acceptance of these terms.
  • Cheques should be made out to Trevor Gilbert & Associates and must accompany the registration form. Registration will only be confirmed on receipt of full payment. Once payment has been received a VAT receipt will be issued which will include any additional items such as accommodation. Any balance over and above payment made is due within 30 days of date of invoice.

Bookings:


  • you may make a provisional booking by contacting the Course Administrator; info@witnessbox.co.uk, or booking online through our web site www.witnessbox.co.uk. Provisional bookings will be held for ten days from the date of enquiry.
  • once a booking is confirmed the booking form constitutes a legally binding contract. The delegate and employer/client are jointly and severally liable for payment of all fees due to Trevor Gilbert & Associates Limited. To the extent permitted by law, neither Trevor Gilbert & Associates Limited nor its presenters will be liable by reason of breach of contract, negligence or otherwise for any loss or consequential loss occasioned to any person acting omitting to act or refraining from acting in reliance upon the course material or presentation of the course or, except to the extent that any such loss does not exceed the price of the course, arising from or connected with any error or omission in the course material or presentation of the course. Consequential loss shall be deemed to include, but is not limited to, any loss of profits or anticipated profits, damage to reputation or goodwill, loss of business or anticipated business, damages, costs, expenses incurred or payable to any third party or any other indirect or consequential loss.

Cancellations:


  • delegates/clients must advise us of their cancellation in writing or email at least 30 working days before the course if they wish to have their fees refunded in full. If notice of cancellation is made after 30 days there will be no refund.
  • we reserve the right to vary or cancel a course where the occasion necessitates (see Changes below).

In the event of a client transfer request to another date, an administration charge of £100 + VAT will be levied. We will endeavour to accommodate changes wherever possible but reserve the right to prioritise our diary.

Changes:

Changes may unexpectedly occur to course schedules, tutor, dates and venues, which may be beyond our control. Where such circumstances force us to cancel a course we shall offer an alternative course date or refund fees paid for the booked course in full.

Confidentiality:

During the course of training confidential information about the client firm and its affairs or clients may come to our attention, in which case we will keep them confidential unless we have a legal obligation to disclose such information.

Legal Advice:

None of the advice given by Trevor Gilbert or any Witness Box tutor may be construed as legal either in tutorials or the materials provided. Specifically, it is not the intention of witness familiarisation tutoring to provide information for the delegate or his/her employer's legal purposes, or to advise others.

Any tutoring including mock cross-examinations must not be based on facts which are the same as or similar to those of any current or impending trial, hearing or proceedings at which a course participant is likely to be a witness.
